The Verwaltungsgericht addressed the competence to impose a provisional suspension on a municipal official elected by the people, including the municipal clerk. It held that, although the municipality's assembly is the disciplinary authority under the Municipal Act, the Municipal Council is responsible for initiating disciplinary proceedings under § 26(2) second sentence of the Liability Act. The court extended that allocation to provisional measures under § 25(5) of the Liability Act and therefore assigned competence to the municipal council.

Die Kompetenzordnung für die Einleitung des Disziplinarverfahrens wird auf vorsorgliche Massnahmen übertragen. Ist nach § 149 lit. a Gemeindegesetz die Gemeindeversammlung Disziplinarbehörde, so ist gleichwohl der Gemeinderat zur Anordnung der vorläufigen Amtseinstellung zuständig, wenn ihm bereits die Einleitung des Disziplinarverfahrens obliegt. Die Zuständigkeitsregel von § 26 Abs. 2 Satz 2 Verantwortlichkeitsgesetz gilt entsprechend auch für Massnahmen nach § 25 Abs. 5 (vgl. Erwägungen des Gerichts).

Nach § 149 lit. a des Gemeindegesetzes ist gegenüber Gemeindebeamten, die vom Volk an der Urne gewählt werden (so also auch gegenüber dem Gemeindeschreiber), die Gemeindeversammlung eigentliche Disziplinarbehörde. Nicht sie, sondern der Gemeinderat ist aber in solchen Fällen nach § 26 Abs. 2 Satz 2 des Verantwortlichkeitsgesetzes zur Einleitung des Disziplinarverfahrens zuständig. Es erscheint richtig, die Ordnung von § 26 Abs. 2 Satz 2 auch auf die Zuständigkeit für Massnahmen nach § 25 Abs. 5 anzuwenden.
