The Schwyz Cantonal Court dealt with an application for a special audit. hat der Kantonsgerichtsvizepräsident,
nachdem sich ergeben und in Erwägung:
dass der Gesuchsteller das Gesuch um Einsetzung eines Sonderprüfers vom 27. Juli 2020 mit Eingabe vom 21. September 2020 nach einer aussergerichtlichen Einigung zurückzog, weshalb das Verfahren gestützt auf Art. 241 Abs. 3 ZPO abzuschreiben ist;
dass bei diesem Verfahrensausgang die Gerichtskosten gestützt auf Art. 106 Abs. 1 ZPO dem Gesuchsteller aufzuerlegen sind;
dass die Gesuchsgegnerin gemäss Eingabe vom 21. September 2020 auf eine Parteientschädigung verzichtet (KG-act. 10);
dass die Abschreibung des Verfahrens in die Kompetenz des Vorsitzenden fällt (§ 40 Abs. 2 i.V.m. § 41 Abs. 1 JG);-
verfügt:
1. Das Verfahren wird abgeschrieben.
2. Die zweitinstanzlichen Kosten von Fr. 300.00 werden dem Gesuchsteller auferlegt und vom geleisteten Kostenvorschuss von Fr. 3‘000.00 bezogen. Der Restbetrag von Fr. 2‘700.00 wird ihm durch die Kantonsgerichtskasse zurückerstattet.
3. Parteientschädigungen werden nicht zugesprochen.
4. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Art. 72 ff. des Bundesgerichtsgesetzes (BGG) unabhängig vom Streitwert (Art. 74 Abs. 2 lit. b BGG i.V.m. Art. 5 Abs. 1 lit. g ZPO) Beschwerde in Zivilsachen beim Bundesgericht in Lausanne eingereicht werden; die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.
5. Zufertigung an Rechtsanwalt B.________ (2/R), Rechtsanwalt D.________ (2/R, unter Beilage einer Kopie von
KG-act. 10) und nach definitiver Erledigung an die Kantonsgerichtskasse (1/ü, im Dispositiv).
