The Second Civil Chamber of the Ticino Court of Appeal dealt with a direct appeal in which the claimant sought CHF 1,200,000 plus interest. After the parties had twice agreed to suspend the proceedings, the claimant informed the court that, together with the defendant, it was withdrawing the petition and requesting that the case be removed from the docket. The court accepted the withdrawal, struck the case off the roll, and ordered the costs and court fee of CHF 3,600, already advanced by the claimant, to be borne equally by both parties, with party costs compensated.
Art. 352 CPC; withdrawal of the action in appeal proceedings and costs allocation. Where the claimant withdraws the petition with the opponent's agreement, the appellate court strikes the cause off the roll. In the absence of a different agreement or special circumstances, the parties may validly settle the allocation of costs, including equal sharing of court costs and compensation of party costs (consid. implicit).

tenuto conto in particolare che le parti si sono accordate nel senso che le spese vengono assunte metà per parte con compensazione delle ripetibili;
richiamato l'art. 352 CPC;
decreta
La causa dipendente da petizione 28 agosto 1996 di __________ nei confronti di __________ (inc. no. __________ di questa Camera) è stralciata dai ruoli.
Le spese e la tassa di giustizia, per complessivi fr. 3'600.--, già anticipate dall'attrice, sono poste a carico delle parti in ragione di metà ciascuna. Le ripetibili sono compensate.
