The Pretura penale of Bellinzona, sitting with Judge Marco Ambrosini, dealt with an opposition to a criminal decree issued by Procuratore pubblico Antonio Perugini. During the hearing, the accused withdrew the opposition. The court therefore struck the case from the docket, declared the decree enforceable, returned the file to the public prosecutor, and ordered that no court fee be charged, with costs borne by the State.
Arts. 210-211 CPP; withdrawal of opposition to a criminal decree. If the accused withdraws the opposition during the hearing, the opposition proceedings are terminated, the case is struck off the docket, and the decree d’accusa becomes enforceable. The court may then return the file to the public prosecutor for further action within his competence. Unless otherwise ordered, no justice fee may be levied and the costs may be placed at the State’s charge (consid. 1-2).

Effect of the withdrawal of opposition to the criminal decree
The opposition was withdrawn during the hearing, so the proceedings were removed from the docket and the criminal decree became enforceable.
Under Arts. 210 and 211 CPP, withdrawal of the opposition ends the opposition proceedings and restores the enforceability of the decree.
