The defendant withdrew her opposition to a penalty order issued by the public prosecutor. The Pretura penale therefore struck the case from the roll, declared the penalty order enforceable, and cancelled the hearing scheduled for 8 July 2003. The court also ordered that no fees or costs be collected and returned the file to the prosecutor for further competence.
Art. 210-211 CPP; withdrawal of the objection to a penalty order: once the objection is validly withdrawn, the objection proceedings are discontinued, the case is removed from the docket, and the penalty order acquires enforceability; the scheduled public hearing falls away. If the order so provides, no court fees or expenses are levied.
