The President of the Pretura penale noted the withdrawal of the accused’s opposition to a criminal decree of accusation. Applying Arts. 210 and 211 CPP, he ordered the case struck off the docket and declared the decree enforceable. No justice fee was imposed, but the procedural costs of CHF 30 were borne by the objector. The file was returned to the public prosecutor for any further action within his competence.
Art. 210-211 CPP; withdrawal of opposition to a criminal decree of accusation: once the opposition is validly withdrawn, the court discontinues the opposition proceedings, strikes the matter from the docket, and the decree of accusation acquires enforceability. The costs of the summary discontinuance may be charged to the objector; the court may waive a justice fee and allocate only the procedural expenses (consid. no designation).
