In an objection procedure against a penalty order, the accused withdrew the objection during the hearing. The Pretura penale struck the case from the docket and declared the penalty order enforceable. The objecting party was ordered to pay court costs of CHF 80 in total, consisting of a CHF 50 judicial fee and CHF 30 expenses.
Art. 210 cpv. 3 CPP; withdrawal of objection against a penalty order; where the accused withdraws the objection at the hearing, the court strikes the proceedings off the docket and the penalty order becomes enforceable. The procedural consequence follows directly from the withdrawal; the objecting party may be charged with the court fee and expenses arising from the decision.
