The Second Civil Chamber of the Ticino Court of Appeal struck an appeal in a special tenancy matter because the appellants did not pay the CHF 1,000 advance on costs within the deadline set by the president. The earlier warning stated that non-payment would lead to the appeal being declared deserted under Art. 312 CPC. The court therefore removed the appeal from the docket and charged the appellants jointly and severally with CHF 80 in costs.
Art. 312 CPC; failure to pay the ordered advance on costs within the time limit set under threat of non-entry entails procedural extinction of the appeal. Where the appellant does not comply with the advance-payment order despite clear warning, the appellate court strikes the remedy from the roll without examining the merits. The unsuccessful appellants bear the court costs of the dismissal order.

richiamata la diffida 18 agosto 1999 del presidente di questa Camera mediante la quale ai ricorrenti veniva assegnato un termine scadente il 6 settembre 1999 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 1000.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
preso atto come il termine in questione sia infruttuosamente trascorso;
decreta 1. L'appello 16 agosto 1999 di __________, __________, avverso la decisione 30 luglio 1999 del segretario assessore della Pretura di Bellinzona, è stralciato dai ruoli per mancato versamento dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 80.-- sono poste a carico degli appellanti in solido.
Intimazione:
Comunicazione alla Pretura del Distretto di Bellinzona.
