The applicant appealed a first-instance decree refusing eviction of the respondents from the premises of the "__________" in __________. Before the appellate court could rule on the merits, the appellant’s counsel filed a written withdrawal of the appeal. The Second Chamber of Civil Law of the Court of Appeal therefore struck the appeal from the docket and ordered the appellant to bear the court fee and expenses, totalling CHF 70.
Art. 352 CPC; withdrawal of appeal and costs: where the appellant expressly withdraws the appeal, the appellate court discontinues the second-instance proceedings by striking the case from the docket. Costs are ordinarily borne by the party that rendered the proceedings unnecessary through withdrawal, including the court fee and disbursements.

Ritenuto che il patrocinatore dell'appellante __________ ha dichiarato, con scritto 18 settembre 2002, di ritirare l'appello 29 agosto 2002 e che di conseguenza va messo fine alla procedura di seconda istanza con decreto di stralcio e con il carico della tassa e delle spese di giudizio all'appellante che le ha inutilmente cagionate.
Visti l'art. 352 CPC
e, per le spese, la vigente TG
decreta
L'appello 29 agosto 2002 di __________ è stralciato dai ruoli.
La tassa di giustizia di Fr. 50.- e le spese di Fr. 20.- (totale Fr. 70.-) sono a carico dell'appellante.
