The appellant challenged a 12 December 2002 decision of the Pretore of Lugano, Section 5, in accelerated execution and bankruptcy proceedings concerning a revendication action, and asked the Court of Appeal for suspensive effect. The Second Civil Chamber of the Ticino Court of Appeal, presided over by Bruno Cocchi, considered the request appropriate and granted suspensive effect to the appeal.
Art. 398 cpv. 2 CPC; art. 310 cpv. 4 lett. e) CPC: in appeal proceedings, suspensive effect may be granted where the court deems it appropriate in light of the request made in the appeal; the measure is discretionary and concerns the provisional procedural status of the contested decision pending the appeal outcome.

decreta 1. All’appello 20 dicembre 2002 di cui sopra, è accordato effetto sospensivo.
