The Ticino Chamber of enforcement and bankruptcy dealt with an appeal against a Lugano district magistrate decision. The appellant had been ordered to pay an advance of CHF 180 by 1995-04-24, with the warning that failure to pay would cause the appeal to be treated as abandoned under Art. 312 CPC. As the deadline passed without payment, the court struck the appeal from the docket and charged the appellant CHF 50 in court costs.

la decisione 27 marzo 1995 del Pretore del Distretto di Lugano nella causa promossa da
richiamata la diffida 5 aprile 1995 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 24 aprile 1995 per effettuare sul c.c.p. 69-133.4 della Tesoreria del Tribunale di appello un deposito di fr. 180.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
preso atto come il termine in questione sia infruttuosamente trascorso;
decreta 1. L'appello 3 aprile 1995 di __________, avverso la decisione 27 marzo 1995 del Pretore del Distretto di Lugano, è stralciato dai ruoli per mancato versamento dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
