A supervisory complaint concerning the enforcement of a real-estate pledge was withdrawn by the complainant during the proceedings. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal therefore struck the complaint from the docket as moot and ordered no costs or indemnities. The earlier stay order became irrelevant after the withdrawal.
Art. 67 cpv. 2 e 68 cpv. 2 OTLEF; withdrawal of a supervisory complaint renders the proceeding devoid of object and leads to its striking off the roll. Where the complaint is withdrawn, the authority does not enter into the merits and may dispense with costs and indemnities in accordance with the applicable procedural rules. The dispositive follows the principle that a discontinued or withdrawn complaint no longer requires adjudication on the contested enforcement act.
