A complaint was filed against the Lugano bankruptcy office for alleged delay in the bankruptcy proceedings. Before the supervisory court ruled on the merits, the complainant requested withdrawal, explaining that the bankruptcy distribution list had been deposited as of 17 July 1995. The Chamber of enforcement and bankruptcy of the Ticino Court of Appeal granted the request and struck the complaint from the docket. It also ordered that no costs be charged and no indemnity be awarded.
Art. 67 cpv. 2 OTLEF, 68 cpv. 2 OTLEF; if the complainant withdraws a supervisory complaint in bankruptcy matters, the supervisory authority strikes the proceeding from the docket. Where the request for withdrawal is grounded in the subsequent elimination of the complained-of delay, the case becomes devoid of purpose and is not decided on the merits. In the absence of special circumstances, no costs or indemnity are awarded (consid. implicit).
