The supervisory chamber of the Ticino Court of Appeal dealt with a complaint against an auction in multiple enforcement proceedings. After the complainant’s counsel withdrew the complaint and no suspensive effect had been granted, the court held that the matter had become moot and struck it from the docket. It also ordered that no costs and no indemnities be charged.
Art. 67 cpv. 2 and 68 cpv. 2 OTLEF; withdrawal of the complaint in enforcement-supervision proceedings renders the remedy without object and leads to striking it from the roll. Where the complainant withdraws the appeal before adjudication, the supervisory authority does not examine the merits; in the absence of any specific order, no costs or indemnities are awarded.
