The complainant filed a supervisory complaint against an attachment order in enforcement proceedings before the Ticino Court of Appeal's debt-enforcement chamber. Before judgment, the complainant withdrew the complaint by letter of 9 January 1998. The court held that the appeal had thus become devoid of object and struck it from the docket. It also ordered that no costs be charged and no indemnities be granted.
Art. 61 cpv. 2 lett. a and art. 62 cpv. 2 OTLEF; withdrawal of a supervisory complaint in enforcement matters renders the case devoid of object and leads to striking it from the docket. Upon withdrawal, the reviewing authority may close the proceedings without costs or indemnities, absent any special reason to do otherwise.
