The complainant challenged the Blenio debt enforcement office for delayed justice in an enforcement proceeding. During the pendency of the supervisory complaint, the underlying debt of CHF 3,313.45 was paid in full, which rendered the complaint devoid of object. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal therefore struck the complaint from the docket and ordered that no costs or indemnities be charged.
Art. 61 cpv. 2 lett. a e 62 cpv. 2 OTLEF; where, in a supervisory complaint against the conduct of a debt enforcement office, the underlying enforcement proceeding is satisfied and the complaint thereby loses its object, the matter must be struck from the docket. In such cases, absent a remaining live controversy, the court does not adjudicate the merits of the alleged delay. The consequence is termination of the proceedings as moot, with no costs and no indemnity unless a special reason for allocation exists.
