The supervisory complaint against the Lugano enforcement office was withdrawn on 18 April 2000. The Camera di esecuzione e fallimenti of the Ticino Court of Appeal therefore held that the appeal had become moot and ordered it struck from the docket. The court also decided that no court fees would be charged and no indemnity would be granted. A further appeal to the Federal Debt Enforcement and Bankruptcy Chamber was indicated under Art. 19 LEF.
Art. 20a cpv. 1 LEF; Art. 61 cpv. 2 lett. a OTLEF; Art. 62 cpv. 2 OTLEF: where a supervisory complaint is withdrawn, the dispute loses its object and the proceedings are to be struck from the docket. In such a situation, absent special circumstances, no court costs and no party compensation are awarded. The decision is appealable under Art. 19 LEF.
