In an accident-insurance appeal, the Ticino Cantonal Insurance Court taxed the appointed counsel’s fee note after legal aid had been granted. The court fixed the compensation at CHF 909.10, VAT included, ordered no court fee, and placed the expenses on the State. It also indicated that both counsel and the Department of Institutions could challenge the fee amount before the Council of Moderation within 15 days.
Procedural law, Art. 21; taxation of court-appointed counsel’s fee note after legal aid has been granted. The deciding court reviews the submitted fee note and fixes the remuneration at the amount deemed appropriate, including VAT where applicable. In such taxation orders, no justice fee may be levied and the expenses may be borne by the State. The determination of the fee amount is subject to appeal by the appointed counsel and the opposing administrative department within the prescribed short time limit (consid. 1-3).

visto in particolare l'art. 21 della Legge di procedura 6.4.61;
ordina 1. La nota è tassata in fr. 909.10 (IVA compresa);
Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.
Contro l'ammontare dell'onorario il patrocinatore e il Dipartimento delle Istituzioni possono ricorrere entro 15 giorni al Consiglio di moderazione.
