The Ticino Administrative Court dealt with an appeal against a State Council decision concerning a 1989 parish tax of CHF 379. Before judgment, the parish informed the court that it was withdrawing the challenge because of intervening legislative amendments. The court therefore struck the appeal from the docket. It ordered no court fees or costs, but treated the withdrawal as equivalent to defeat for the purposes of party compensation and ordered the appellant to pay CHF 100 to the respondent.
Art. 273 vLT; arts. 8, 12, 28 TOA; arts. 3, 18, 28, 31, 60, 61 PAmm: where the appellant withdraws the appeal during the proceedings, the administrative court strikes the matter from the docket. Withdrawal is assimilated to loss only for the allocation of party compensation; in the absence of special circumstances, no court fees or costs are levied. The court may therefore order the withdrawing party to pay modest ripetibili to the opposing party (consid. non specified).

Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
La ricorrente rifonderà fr. 100.-- alla resistente a titolo di ripetibili.
