The appellant challenged a State Council decision concerning the postposition of a municipal debt claim. After the court invited him to state whether he wished to maintain the appeal, he confirmed on 26 June 1995 that he was withdrawing it. The Administrative Court therefore struck the appeal from the docket and ordered that no fees or costs be levied.
Withdrawal of an administrative appeal; once the appellant unequivocally withdraws the remedy, the appellate proceedings become moot and the court strikes the case from the docket. In such circumstances, absent special reasons, no court fees or costs are levied (consid. 1-2).

la decisione del 15 marzo 1995, no 1498, con cui il Consiglio di Stato ha respinto il ricorso 6 settembre 1994 dell'insorgente contro la risoluzione 4 novembre 1993 del municipio di __________ di postergazione del credito vantato dal Comune di __________ nei confronti di __________;
visto che, con risoluzione 8 maggio 1995, il Consiglio Comunale di __________ ha ratificato l'avversata postergazione di credito;
ritenuto che, dietro corrispondente sollecitazione del municipio di __________ di data 9/12 giugno u.s., con scritto 14 giugno 1995 questo Tribunale ha invitato il ricorrente a dichiarare se intendeva mantenere il ricorso 28 marzo 1995;
preso atto che in data 26 giugno 1995 il ricorrente ha comunicato di ritirare il gravame;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano tasse e spese.
