The appellant challenged the refusal of a building permit for works in the village core, but her counsel withdrew the appeal on 27 October 1998. The Ticino Administrative Court therefore struck the case from the roll. It held that the withdrawal ended the proceedings, yet awarded party compensation to the respondents assisted by licensed counsel. No court fees or expenses were levied.
Administrative appeal withdrawn; the court strikes the case from the roll once the withdrawal is communicated and the proceedings are thereby exhausted. Even where the appeal is terminated in this manner, the court may award party compensation to the successful respondents if they were represented by licensed counsel; court fees may nevertheless be waived.

la decisione 29 aprile 1998, no. 1834, del Consiglio di Stato che respinge l'impugnativa presentata dall'insorgente avverso la risoluzione 29 dicembre 1997 con cui il municipio di __________ le ha negato la licenza edilizia per ristrutturare e sopraelevare uno stabile situato nella zona del nucleo (part. no. __________ RFD);
preso atto che in data 27 ottobre 1998 il patrocinatore della ricorrente ha comunicato di ritirare il ricorso;
ritenuto nondimeno che alle resistenti __________ e Comunione ereditaria fu __________ assistite da legali iscritti all'albo va riconosciuta un'indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
La ricorrente verserà fr. 500.-- alla __________ e identico importo alla Comunione ereditaria fu __________ quale indennità per ripetibili.
