la decisione 20 maggio 1998, no. 2254, del Consiglio di Stato che respinge il ricorso presentato dall'insorgente avverso la risoluzione 9 marzo 1998 del municipio di __________, con la quale rilasciava a __________ e __________, gerenti dell'Osteria __________, l'autorizzazione per utilizzare una parte dell'area pubblica antistante detto commercio;
preso atto che in occasione dell'udienza di sopralluogo 24 luglio 1998 il ricorrente ha dichiarato di ritirare il ricorso mentre che il resistente __________ ha rinunciato ad esigere l'indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
