The Cantonal Administrative Court dealt with an appeal against a municipal building permit confirmed by the Council of State. After the appellant’s counsel notified the court that the appeal was being withdrawn because an amicable settlement had been reached with the opposing party, the court held the proceedings to be concluded. It therefore struck the appeal from the docket and ordered that no court fees or costs be collected.
Withdrawal of appeal following an amicable settlement; the proceedings become moot and are struck from the roll. In such a situation, the court may terminate the case without entering into the merits and, depending on the circumstances, refrain from levying court costs or fees (consid. 1-2).
