The Ticino Administrative Court dealt with appeals against a State Council decision that had upheld the Department of the Territory’s challenge to a municipal building permit for alterations to a rustic outside the building zone. Before the merits were decided, the municipality and one appellant notified the court that they were withdrawing their appeals. The court held that the proceedings were therefore exhausted, ordered the cases struck from the docket, and decided that no court fees or costs would be charged.
Withdrawal of an appeal before the cantonal administrative court renders the proceedings moot and justifies striking the case from the docket; where the proceedings end in this manner, the court may order that no fees or costs be levied. The dispositive consequence follows from the parties’ withdrawal declaration and does not require a merits determination on the challenged administrative decision.
