The appellant withdrew its appeal against a State Council procurement award. The Ticino Cantonal Administrative Court therefore struck the appeal from the docket. It nonetheless ordered the appellant to pay a CHF 300 court fee and to refund CHF 600 in party compensation to the respondent, because the respondent had been represented by counsel entered on the bar roll.

la decisione 10 agosto 2003, n. 3084, del Consiglio di Stato, che delibera alla __________, le opere da pittore esterno e interno occorrenti allo stabile amministrativo __________ a __________;
preso atto che il 22 agosto 2003 il patrocinatore della ricorrente ha chiesto di stralciare il ricorso dai ruoli, senza prelievo di spese e senza attribuzione di ripetibili;
considerato pertanto che il procedimento è così esaurito;
rilevato tuttavia che la resistente si è avvalsa del patrocinio di un legale iscritto all'albo, per cui si giustifica, come da questa richiesto, la corresponsione di un'indennità per ripetibili;
decreta:
Il ricorso è stralciato dai ruoli.
La tassa di giustizia di fr. 300.- è a carico della ricorrente, la quale rifonderà fr. 600.- a titolo di ripetibili alla resistente.
