The appellants challenged the State Council's approval of a zoning plan. Before the tribunal decided the merits, they withdrew the appeal on 11 February 2004 through their representative. The Tribunal della pianificazione del territorio therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no fees or costs be collected.
Withdrawal of appeal; strike-off from the roll and costs: where the appellants withdraw the appeal, the proceedings become moot and the court must remove the case from the docket. In the absence of a merits decision, no court fees or costs are levied (consid. 1-2).
