The appellants challenged the norms of implementation of a detailed industrial zoning plan directly before the Territorial Planning Court. The court held that, under Art. 35 LALPT, such a challenge had to be filed with the Council of State within 15 days after the publication period. Although the appeal was timely, it was brought before the wrong authority and was therefore inadmissible before the TPT. The file was struck from the docket and transmitted to the Council of State. No fees or costs were charged.
Art. 35 LALPT; Art. 4 LPAmm; direct appeal against the content of a detailed plan filed with the wrong authority. A challenge to the content of a planning instrument must be brought within 15 days after expiry of the publication period before the Council of State; if the appeal is lodged timely but before an incompetent authority, the latter must strike the matter from the docket and transmit the file to the competent authority pursuant to Art. 4 LPAmm. The defect concerns jurisdiction only and does not render the remedy untimely.

visto
che la ricorrente insorge contro le norme di attuazione del piano particolareggiato in epigrafe, adottato dal Consiglio comunale il 25 settembre 1995 e pubblicato dal 2 novembre al 1. dicembre 1995;
considerato
che a norma dell’art. 35 LALPT contro il contenuto del piano è dato ricorso al Consiglio di Stato entro quindici giorni dalla scadenza del termine di pubblicazione;
che di conseguenza il ricorso, tempestivo, è stato erroneamente introdotto dinnanzi al TPT ed è inammissibile in questa sede;
che se ne impone dunque lo stralcio e la trasmissione a norma dell’art. 4 LPAmm all’autorità competente, ossia al Consiglio di Stato;
decreta
Il ricorso é stralciato dai ruoli e trasmesso al Consiglio di Stato.
Non si prelevano tasse e spese.
