An appeal was filed against the Cantonal State Council’s approval of a detailed plan. After the new owner declared that the matter had lost practical and legal significance, the court held that the case was moot and struck the appeal from the docket. It ordered that no court fees or costs be taken.
Mootness; lack of current legal interest in planning appeals: where the subject matter of the appeal ceases to present a legally protected interest during the proceedings, the court strikes the case from the docket. In such circumstances, if no further adjudication is required, no fees or costs are levied.
