At the appeal hearing before the Ticino Planning Tribunal of Appeal, the municipality agreed to further examine the contested planning problems with the cantonal planning office and to involve the appellants. In light of this agreement, the court did not decide the merits and instead suspended the proceedings, leaving them to be resumed on application by a party.
