__________ SA appealed a 2002 forestry authority decision concerning the delimitation of forest area adjoining buildable land. Before the Tribunal of the territorial planning ruled on the merits, the appellant's counsel notified the court in writing that the appeal was withdrawn. The President of the Tribunal therefore struck the appeal from the docket and ordered that no fees or costs be collected.
Withdrawal of an appeal; strike-out of the proceedings and costs. Where an appellant withdraws the appeal before a merits decision, the appeal is removed from the docket as moot, and the court may order that no fees or costs be levied, particularly when the withdrawal occurs promptly and no substantive adjudication takes place.
