Whether an appeal lies against a superprovisional order under the CPC
No appeal or other ordinary remedy is available against a superprovisional order; the proper remedy is the prompt reconsideration procedure under Art. 265 para. 2 CPC.
Art. 308 para. 1 lit. b CPC governs appeals against first-instance provisional measures, but the CPC does not provide an appeal or complaint against superprovisional orders, even if the other party was not heard. The rapid reconsideration required by Art. 265 para. 2 CPC constitutes the remedy against such a decision.
