Whether the appeal became moot after the insurer issued a new contribution decision based on the ordinary tax assessment
The appeal became moot because the new decision replaced the challenged one.
Under Art. 53(3) LPGA the insurer may reconsider a contested decision before sending its response; since the new decision fully took account of the ordinary tax assessment, there was no longer a live dispute.
