Whether the appeal remained admissible after the insurer reconsidered its opposition decision under Art. 53(3) LPGA
The insurer validly reconsidered the challenged decision during the appeal proceedings; the appeal therefore became moot and had to be struck from the docket.
Under Art. 53(3) LPGA, an insurer may reconsider a decision or opposition decision until it sends its observations to the appellate authority. The insurer did so by its letter of 7 May 2009, accepting the appellant's main request.
