Whether an appeal lies against a non-conciliation act under the Vaud Code of Civil Procedure
No appeal lies against a non-conciliation act; the appellant therefore lacked a legally protected interest in modification of the operative part.
A non-conciliation act is issued when conciliation fails under Art. 132 CPC. Any procedural defect in prior conciliation must be raised in the subsequent action by procedural exception, not by appeal against the non-conciliation act. An incorrect indication of appeal remedies cannot create a remedy that does not exist.
