The Obergericht, II. Zivilkammer, decided a cost question after remand in a civil appeal. It held that although the current fee ordinance no longer expressly mentions remand as a reduction ground, the fee must still be lowered by analogy to a procedural order. Taking a dispute value of CHF 368,860 as the basis, the court found a reduction to roughly two-thirds of the ordinary fee appropriate.
§ 12 GerGebV; court fee on remand: although the fee ordinance no longer expressly provides a remand reduction, the fee must be reduced by analogy where the appeal results in remand to the lower court. In determining the amount, the dispute value under the appeal request remains the basis for calculation; the reduction shall be fixed with reference to the analogous treatment of procedural orders, and in the case at hand a reduction to about two-thirds of the ordinary tariff was held appropriate (consid. 4).
