Art. 221 ZPO, Art. 132 ZPO. Nennung der eigenen Adresse. Ausnahme vom Grundsatz, dass der (Rechtsmittel-)Kläger seine Adresse nennen muss, unter der Androhung des Nichteintretens (so OGerZH PS110082)

Der (Rechtsmittel-)Kläger gibt eine Adresse an, ist der zuständigen Einwohnerkontrolle aber nicht bekannt. Die angesetzte Frist zum Einreichen einer Wohnsitzbestätigung lässt er ungenutzt. Da die Vollstreckung der Kosten- und Entschädigungsfolgen nicht gefährdet scheint und die Sache spruchreif ist, wird auf Weiterungen verzichtet.

(aus den Erwägungen des Obergerichts:) 3. Da der Wohnort des Beklagten offenbar nicht klar ist (act. 58, Notiz über eine Anfrage der Gerichtskanzlei bei der Gemeindeverwaltung X.), wurde ihm aufgegeben, eine Wohnsitzbestätigung einzureichen (act. 60). Auch diese Frist hat er versäumt. Weiterungen drängen sich allerdings nicht auf, nachdem das Verfahren nicht weiter geht. Sowohl die Gerichtskasse als auch die Gegenpartei können für ihre Ansprüche sofort oder nach einer kurzen Zahlungsfrist Arrest legen (Art. 271 Abs. 1 Ziff. 6 SchKG), und das mögliche unbewegliche Arrestsubstrat ergibt sich aus den Steuererklärungen, welche im vorliegenden Verfahren eingereicht worden sind (act. .....). Auch die legitimen Interessen der Gegenpartei verlangen also nicht, dass das Gericht von Amtes wegen weitere Nachforschungen anstellt - umso mehr, als sich der Beklagte einer Betreibung jederzeit durch eine -weitere- Verlegung des Wohnsitzes fürs Erste entziehen könnte (Art. 53 SchKG).
