In an appeal concerning legal aid, the Obergericht held that proceedings on unentgeltliche Rechtspflege are free of charge under Art. 119(6) CPC, save for bad faith or abuse. The court further stated that this cost exemption also applies to any appellate proceedings. The decision therefore addressed only the allocation of costs and declined to impose court costs.
Art. 119 Abs. 6 ZPO; Kostenfreiheit im Verfahren um unentgeltliche Rechtspflege auch im Rechtsmittelverfahren. Verfahren über die unentgeltliche Rechtspflege sind grundsätzlich kostenlos; Kosten dürfen nur bei Bös- oder Mutwilligkeit auferlegt werden. Die Kostenfreiheit erstreckt sich nicht bloss auf das erstinstanzliche Gesuchsverfahren, sondern auch auf ein allfälliges Rechtsmittelverfahren (E. 2).
Gesuch um unentgeltliche Rechtspflege, Kosten Art. 119 Abs. 6 ZPO gilt auch für das Rechtsmittelverfahren (Erwägungen des Obergerichts:) (V./2) In Verfahren um die unentgeltliche Rechtspflege werden, ausser bei Bös- und Mutwilligkeit, keine Kosten erhoben (Art. 119 Abs. 6 ZPO). Under Art. 119(6) CPC, no costs are charged in legal-aid proceedings except in cases of bad faith or abuse; this cost-free regime also applies to any appellate proceeding.
The court relied on the wording and purpose of Art. 119(6) CPC and held, with reference to commentary, that the exemption from costs extends to the remedy stage as well.
