The Zurich Higher Court’s Administrative Commission dealt with an application to recuse a district judge in divorce proceedings before the District Court of Uster. After the challenged judge submitted a statement and the applicant was invited to comment, the applicant withdrew the recusal request. The court therefore discontinued the recusal proceedings, fixed the court fee at CHF 300, charged the fee to the applicant, and denied any party compensation.
Withdrawal of a recusal application terminates the recusal proceedings without a merits decision; the proceedings are struck off as moot. The withdrawing applicant normally bears the procedural costs, and no party compensation is awarded absent special grounds. Consider. 1-3.

Erwägungen: 1. Am 13. Juli 2011 stellte der Gesuchsteller ein Ablehnungsbegehren gegen Bezirksrichter lic. iur. C._____ im Verfahren FE100325-I des Bezirksgerichts Uster (act. 2). 2. Mit Eingabe vom 21. Juli 2011 gab der Abgelehnte aufforderungsgemäss ei- ne gewissenhafte Erklärung i.S.v. § 100 GVG ab (act. 1), welche dem Ge- suchsteller mit Verfügung vom 3. August 2011 zur allfälligen Stellungnahme zugestellt wurde (act. 4). 3. Mit Eingabe vom 11. August 2011 hat der Gesuchsteller sein Ablehnungs- begehren zurückgezogen (act. 5). Es wird beschlossen: 1. Das Verfahren wird als durch Rückzug des Ablehnungsbegehrens erledigt abgeschrieben. 2. Die Staatsgebühr wird auf Fr. 300.– festgesetzt. 3. Die Kosten werden dem Gesuchsteller auferlegt. 4. Es wird keine Parteientschädigung zugesprochen. 5. Schriftliche Mitteilung an die Parteien, je gegen Empfangsschein, an den Abgelehnten unter Beilage eines Doppels von act. 5. 6. Eine all fällige Beschwerde gegen diesen Entscheid ist innerhalb von 30 Ta- gen von der Zustellung an beim Schweizerischen Bundesgericht, 1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde richten sich nach Art. 72 ff. (Beschwerde in Zivilsachen) oder
Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 und 90 ff. des Bundesgesetzes über das Bundesgericht (BGG).
