In this first-instance civil judgment, the Aachen District Court ordered the defendants to refrain from opposing the plaintiffs’ planned privacy fence, provided it is set at least 0.50 m from the boundary and does not exceed 1.90 m in height. Die Beklagten werden verurteilt, es künftig zu unterlassen, gegen den von den Klägern geplanten Sichtschutzzaun, welcher einen Grenzabstand von 0,50 m nicht unterschreiten und eine Höhe von 1,90 m nicht überschreiten darf, vorzugehen.
Die Kosten des Rechtsstreits haben die Beklagten als Gesamtschuldner zu tragen.
Das Urteil ist vorläufig vollstreckbar. Die Beklagten können die Zwangsvollstreckung der Kläger durch Sicherheitsleistung in Höhe von 700,00 DM abwenden, wenn nicht diese zuvor in derselben Höhe Sicherheit leisten.
