In a first-instance judgment, the Aachen District Court ordered the defendant to pay separation maintenance to G T and child maintenance for M T. For the past period identified in the tenor, it awarded DM 163 in separation maintenance and DM 41 in child maintenance, with 4% interest on specified staged amounts of the child-maintenance arrears. From August 0000, the monthly amounts due after crediting voluntary payments were DM 40.75 for separation maintenance and DM 10.25 for child maintenance, payable in advance. Tenor

Der Beklagte wird zu folgenden Unterhaltszahlungen an die Klägerin verurteilt:

für die Monate März 0000 und Mai bis Juli 0000

a)

Trennungsunterhalt für G T in Höhe von insgesamt 163,00 DM

b)

Kindesunterhalt für M T in Höhe von insgesamt 41,00 DM nebst 4 % Zinsen aus 51,00 DM ab 00.00.00, aus 102,00 DM ab 00.00.00, aus 153,00 DM ab 00.00.00 und aus 204,00 DM ab 00.00.0000.

Ab August 0000

a)

Trennungsunterhalt fur G T monatlich 394,00 DM abzügl. freiwillig gezahlter 353,25 DM = 40,75 DM,

b)

Kindesunterhalt für M T monatlich 128,00 DM, abzüglich freiwillig gezahlter 117,75 DM = 10,25 DM.

Der Unterhalt ist monatlich im voraus fällig.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden zu 79 % der Klägerin zu 21 % dem Beklagten auferlegt.

Das Urteil ist vorläufig vollstreckbar.

Den Parteien wird jedoch nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des jeweils zur Vollstreckung gelangenden Betrages abzuwenden, sofern nicht die jeweils andere Partei zuvor Sicherheit in gleicher Höhe leistet.
