Tenor

Der Beklagte wird verurteilt, an die Kläger 313,93 Euro nebst Zinsen in Höhe von 5 %-punkten über dem jeweiligen Basiszinssatz seit dem 28.12.2002 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Kläger als Gesamtschuldner zu 47 % und der Beklagte zu 53 %.

Das Urteil ist vorläufig vollstreckbar.
