Die Beklagte wird verurteilt, an den Kläger 2.345,28 € nebst Zinsen in Höhe von 5 Pro-zentpunkten über dem Basiszinssatz aus 1.682,98 € seit dem 23.03.2005 und aus 144,59 € seit dem 28.04.2005 zu zahlen.
Im übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 8 % und die Beklagte zu 92 %.
Das Urteil ist vorläufig vollstreckbar, für den Kläger jedoch nur gegen
Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages.
