Tenor

Die Beklagte wird verurteilt, an den Kläger 94,00 € und 22,62 € vorge-richtliche Rechtsanwaltsgebühren jeweils nebst Zinsen von in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 21.06.2006 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits tragen der Kläger 84% und die Be-klagte 16%.

Das Urteil ist vorläufig vollstreckbar.
