In dem Rechtsstreit
hat das Amtsgericht – Familiengericht – Aachen
aufgrund der mündlichen Verhandlung vom 04.03.2008
für R e c h t erkannt:
Das Versäumnisurteil des Familiengerichts Aachen vom 12.10.2006 wird inso-weit aufgehoben, als der Beklagte verurteilt wurde, höheren Unterhalt an die Klägerin zu zahlen als:
Für den Zeitraum Juli 2004 bis Juni 2005 monatlich 1.039,39 €,
für den Zeitraum Juli 2005 bis einschließlich November 2005 monatlich 310,82 €,
für den Zeitraum ab Dezember 2005 monatlich 800,67 €.
Im übrigen wird der Einspruch des Beklagten zurückgewiesen.
Auf die Widerklage wird die Klägerin verurteilt, an den Beklagten den Unterhalt zurückzuzahlen, den er über die oben tenorierten Beträge hinaus aufgrund des Versäumnisurteils vom 12.10.2006 an die Klägerin gezahlt hat.
Die Kosten des Rechtsstreits tragen die Klägerin und der Beklagte je zur Hälfte.
Das Urteil ist vorläufig vollstreckbar.
Der Beklagte kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % der titulierten Beträge abwenden, wenn nicht die Klägerin Sicherheit leistet.
