Tenor
Der Beklagte wird verurteilt, an die Klägerin € 2.823,96 nebst Zinsen in Höhe von 8 Prozentpunkten über dem jeweiligen Basiszinssatz aus einem Betrag in Höhe von € 2.007,83 seit dem 01.03.2011 und aus einem Betrag in Höhe von € 816,13 seit dem 25.05.2011 zu zahlen. Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits haben der Beklagte zu 88% und die Klägerin zu 12% zu tragen.
Das Urteil ist vorläufig vollstreckbar, für die Klägerin jedoch nur gegen Sicherheitsleistung in Höhe von 110% des jeweils beizutreibenden Betrags. Die Klägerin darf die Vollstreckung gegen Sicherheitsleistung in Höhe von 110% des aus dem Urteil vollstreckbaren Betrages abwenden, wenn nicht der Beklagte vor der Vollstreckung in gleicher Höhe Sicherheit leistet.
