Es wird festgestellt, dass der Bausparvertrag mit der Nummer XXX XXX XX durch die Kündigung vom 26.09.2016 nicht beendet wurde.

Die Kosten des Rechtsstreits hat die Beklagte zu tragen.

Das Urteil ist vorläufig vollstreckbar. Die Beklagte kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110% der vollstreckbaren Forderung abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheitsleistung in Höhe von 110% der zu vollstreckenden Forderung leistet.
