In simplified proceedings, the Local Court of Arnsberg partly maintained a payment order issued by the Local Court of Hagen. Tenor

hat das Amtsgericht Arnsberg am 17.04.2007 im vereinfachten Verfahren gem. § 495 a ZPO durch den

für R e c h t erkannt:

Der Vollstreckungsbescheid des Amtsgerichts Hagen vom 15.11.2006 (Gesch-Nr.: 06-5333739-0-4) bleibt mit der Maßgabe aufrecht erhalten, dass der Beklagte verurteilt wird, an die Klägerin 172,07 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweils gültigen Basiszinssatz seit dem 16.06.2006 sowie 5,00 € Mahnkosten, 0,50 € Auskunftskosten und 47,50 € Inkassokosten zu zahlen.

Im Übrigen wird der Vollstreckungsbescheid aufgehoben und die Klage abgewiesen.

Die Kosten des Rechtsstreits werden zu 47 % der Klägerin und zu 53 % dem Beklagten auferlegt. Das gilt nicht für die Kosten der Säumnis, die dem Beklagten auferlegt werden.

Das Urteil ist vorläufig vollstreckbar.
