The Beckum Local Court considered whether a parcel used for leasing and operating a wind turbine remained part of a farm under the Höfeordnung. It held that both leasing and self-use for wind power are non-agricultural uses that end the parcel’s affiliation with the farm. An owner’s intention to resume agricultural use later does not establish temporary non-agricultural use where objective circumstances leave the future use uncertain; the intention is especially less significant if a successor will make that decision. Once the appeal period expires, the court will ask the Land Registry Office to separate the parcel from the registered property, unless the owner timely applies for determination proceedings under § 11(1)(c) HöfeVfO.
HöfeO § 2; HöfeVfO § 7 — Leasing or using a parcel for the operation of a wind turbine constitutes non-agricultural use and causes the parcel to lose its affiliation with a farm. An owner’s intention that non-agricultural use be temporary does not establish temporary use where objective circumstances leave wholly open how the land will be used in the future. The owner’s intention is of reduced weight where, given the owner’s personal circumstances and the duration of the non-agricultural use, the decision about future use is likely to be made by a farm successor.

Verpachtung und Eigennutzung eines Grundstücks zum Betrieb einer Windkraftanlage bilden eine land-wirtschaftsfremde Nutzung.
Die Nutzung einer Parzelle allein zur Verpachtung und Eigennutzung eines Grundstücks zum Betrieb einer Windkraftanlage lassen die Hofzugehörigkeit der Parzelle entfallen.
Der Wille des Eigentümers, das Grundstück (oder den betroffenen Grundstücksteil) nur vorübergehend landwirtschaftsfremd zu nutzen, ermöglicht die Feststellung einer nur zeitweiligen Fremdnutzung nicht, wenn aufgrund objektiver Umstände völlig offen ist, in welcher Weise das Grundstück später genutzt wird. Sein Wille verliert für die Prüfung an Gewicht, wenn die Entscheidung über die spätere Nutzung aufgrund seiner persönlichen Situation und der Dauer der Fremdnutzung ohnehin nicht von ihm, sondern von einem Hofnachfolger getroffen werden wird.
Das Landwirtschaftsgericht wird nach Ablauf der Beschwerdefrist das Grundbuchamt ersuchen, die Parzelle Flur ___ Flurstück ___ von dem Grundstück eingetragen im Grundbuch Amtsgericht Beckum Gemarkung ___ Blatt _ abzuschreiben.
Im Falle eines innerhalb der Beschwerdefrist gestellten Antrags des Hofeigentümers gemäß § 11 Abs. 1 lit. c) HöfeVfO wird das Gericht das Ergebnis des Feststellungsverfahrens abwarten.
