Tenor
Die Beklagte wird verurteilt an den Kläger einen Betrag von 807,50 Euro nebst Zinsen in Höhe von 8 Prozentpunkten über dem Basiszinssatz seit dem 21.09.2010 zu zahlen.
Die Beklagte wird weiter verurteilt, den Kläger von der Gebührenforderung der prozessbevollmächtigten Rechtsanwälte in Höhe von 104, 50 € freizustellen.
Es wird festgestellt, dass die Beklagte keinen Anspruch auf Rückzahlung in Höhe von 622,00 Euro hinsichtlich der Rechnungen für den Reisezeitraum vom 29.07.2010 bis 18.08.2010 hat.
Die Kosten des Rechtsstreits trägt die Beklagte.
Das Urteil ist vorläufig vollstreckbar. Der Beklagten wird nachgelassen, die Vollstreckung des Klägers durch Sicherheitsleistung in Höhe von 110 % des aufgrund des Urteils vollstreckbaren Betrages abzuwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
