Tenor
Die Beklagte wird verurteilt,
an den Kläger 573,11 € nebst Jahreszinsen in Höhe von fünf Prozentpunkten jährlich über dem Basiszinssatz hieraus seit dem 00.00.0000 zu zahlen sowie
den Kläger von außergerichtlich angefallenen, nicht anrechenbaren Rechtsanwaltskosten in Höhe von 41,77 € freizustellen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 57 % und die Beklagte zu 43 %.
Das Urteil ist vorläufig vollstreckbar. Der jeweilige Vollstreckungsschuldner kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages abwenden, wenn nicht zuvor der jeweilige Vollstreckungsgläubiger Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages leistet.
